Terms and Conditions for Unclaimed Tokens or Rewards

1. Scope and Applicability

These Terms and Conditions apply to all users of Solidus AI Tech Ltd (“Solidus AITECH”, “Solidus”, “AITECH”, “we”, “us”, or “our”) who are eligible to receive tokens or rewards through vesting schedules, staking programs, or other participation-based mechanisms available on our platform. These Terms apply only to tokens or rewards distributed after the effective date listed above. Past distributions remain governed by the terms in effect at the time of issuance.

Solidus AI Tech maintains a comprehensive whitepaper outlining the utility and conditions applicable to the AITECH token and associated services. This whitepaper is available to the public at: .

2. Claim Period for Tokens and Rewards

2.1. Users are granted a six (6) month period to claim tokens or rewards following the conclusion of the relevant vesting or staking program.

2.2. If a user does not claim the tokens or rewards within this period, Solidus AI Tech reserves the right, at its sole discretion, to:

  • Reclaim, use, or burn the unclaimed tokens, and

  • Allocate such tokens to support the development of the Solidus AI Tech ecosystem in accordance with the project’s tokenomics.

2.3. Users will receive system-generated notices via the platform and/or registered email prior to claim expiration, consistent with the EU MiCA’s transparency standards.

3. MiCA Compliance and Equal Treatment

3.1. Solidus AI Tech ensures full compliance with EU MiCA consumer protection provisions, including:

  • Transparent and pre-disclosed conditions for claiming tokens;

  • Equal treatment of all users, without discrimination based on nationality or residence, except where restricted by applicable law;

  • No retroactive application of new policies to tokens previously distributed.

3.2. These terms are disclosed before user participation in staking or vesting.

4. Handling Claims in Case of Deceased Users

4.1. In the event of a user’s death, legal heirs or estate representatives may submit a claim for the unclaimed tokens or rewards. The following documents must be submitted:

  • A certified copy of the death certificate of the user;

  • Proof of legal authority, such as a court-issued probate order or certificate of inheritance;

  • A valid government-issued ID of the claimant;

  • Any other documentation reasonably requested by Solidus AI Tech for verification.

4.2. All personal data submitted for this purpose shall be processed in accordance with the General Data Protection Regulation (GDPR) under the lawful bases of:

  • Article 6(1)(c) – legal obligation; and

  • Article 6(1)(f) – legitimate interest of the platform to verify rightful heirs.

4.3. Data collected for these claims shall be retained for a maximum of five (5) years unless a longer period is required by law, after which it shall be securely deleted. In some cases, certain data may be retained beyond the standard five (5) year period if required by applicable financial regulations, fraud investigations, or law enforcement subpoenas.

4.4. If no valid claim is submitted within twelve (12) months from the date of the user's death, Solidus AI Tech reserves the right to process and handle the unclaimed tokens in accordance with Clause 2.2 above.

5. Law Enforcement and Legal Proceedings

5.1. Solidus AI Tech may freeze, delay, or deny any token or reward claim under the following conditions:

  • Receipt of a valid court order, subpoena, or law enforcement request;

  • Reasonable suspicion of fraud, financial crime, sanctions evasion, or other unlawful activity.

5.2. In such cases, Solidus AI Tech may:

  • Cooperate with law enforcement and regulatory agencies, and

  • Delay disbursement of tokens until the matter is resolved.

6. AML and Sanctions Compliance

6.1. All claimants, including heirs, will be screened against applicable sanctions lists and anti-money laundering (AML) databases (e.g., EU, UN, OFAC, FATF lists). Claims submitted by sanctioned individuals or entities will be lawfully denied.

7. User Responsibilities and Awareness

Users are responsible for:

  • Monitoring their account activity, claimable balances, and deadlines;

  • Maintaining up-to-date contact and wallet information;

  • Notifying estate administrators of their digital assets held on the platform.

8. Dispute Resolution and Appeals

8.1. Users who fail to claim tokens within the designated timeframe due to force majeure (e.g., medical emergencies, technical failure) may request a discretionary review within 30 days after the expiration of the claim period.

8.2. Final decisions on such reviews rest solely with Solidus AI Tech and will be made in accordance with fairness, internal compliance standards, and regulatory guidance.

9. Modifications and Updates

Solidus AI Tech reserves the right to update or amend these Terms and Conditions at any time. Notice of such updates will be posted on the platform. Continued use of the platform after such modifications constitutes acceptance of the revised terms.

12. Governing law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of United Kingdom, without regard to conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in United Kingdom.

4.5. Legal heirs may request access to, rectification, or deletion of their submitted data in accordance with GDPR Articles 15–22 by contacting .
