Compute Marketplace – Disclaimer

1. General Disclaimer

The services provided through the Solidus AI Tech Compute Marketplace (“the Platform”) are offered on an “as-is” and “as-available” basis. Solidus AI Tech makes no warranties or guarantees, express or implied, regarding the performance, availability, or results of using the Platform.

Your use of the Platform is at your sole risk.


2. No Warranty of Results

Solidus AI Tech does not guarantee the outcomes of any workloads or computations run using its compute resources. This includes, but is not limited to:

  • Artificial intelligence or machine learning model training

  • High-performance computing (HPC) workloads

  • Cryptocurrency mining (in jurisdiction where cryptocurrency mining is legal)

  • Blockchain node operation or validation

  • Rendering or scientific computing tasks

Performance depends on many external factors beyond our control, including code structure, configuration, third-party software, or user error.


3. Third-Party Use Responsibility

Users are solely responsible for how they utilize the rented compute power or GPU. Solidus AI Tech does not monitor the real-time content or intent of user computations, and is not liable for:

  • Content created or processed on the Platform

  • Use of compute resources for unauthorized, illegal, or unethical purposes

  • Violation of intellectual property, privacy, or export control laws

It is your responsibility to ensure your usage complies with all applicable laws and our Acceptable Use Policy.


4. Limitation of Liability

To the fullest extent permitted by law, Solidus AI Tech shall not be liable for any:

  • Indirect, incidental, punitive, or consequential damages

  • Loss of profits, data, or business opportunities

  • Regulatory penalties, reputational harm, or litigation arising from user misuse

  • System downtime, interruptions, or unauthorized access by third parties

Solidus AI Tech’s total liability, if any, shall not exceed the total fees paid by the user for compute services in the preceding 30 days. (Please review for accuracy)


5. Security and Availability Disclaimer

We implement appropriate technical and organizational security measures. However, we do not guarantee that the Platform will be free from unauthorized access, malware, cyberattacks, or service interruptions.

You acknowledge that cloud-based compute services carry inherent risks and agree to take reasonable precautions when uploading or executing any code.


6. Regulatory Compliance Disclaimer

Solidus AI Tech makes no representations that its services comply with the laws or regulations of every jurisdiction. It is the user’s responsibility to:

  • Avoid prohibited activities (e.g., sanctions violations, export-controlled technology misuse)

  • Comply with any jurisdiction-specific requirements, including data sovereignty, tax reporting, and restricted content use

Users from embargoed or OFAC-restricted countries are prohibited from accessing the Platform.


7. Force Majeure

We are not liable for any delay or failure in service due to causes beyond our reasonable control, including natural disasters, labor strikes, war, government action, cyberattacks, or third-party service provider failures.


8. Changes to This Disclaimer

Solidus AI Tech may update this Disclaimer at any time. Updates will be posted on the Platform, and your continued use constitutes acceptance of the revised Disclaimer.
